A 2026 guide to Health Canada cannabis security clearances: who needs one under the Cannabis Regulations, the CTLS process and fees, and how to plan renewals.

Health Canada Cannabis Security Clearance Requirements in 2026

Health Canada security clearances are mandatory background checks for the key people behind every cannabis cultivation, processing, and sale for medical purposes licence in Canada. Each application goes through the Cannabis Tracking and Licensing System (CTLS), costs $2,041 per person as of the April 2025 fee adjustment, and stays valid for a maximum of five years. Health Canada will not issue a licence until every required individual holds a clearance.

That makes clearances a gating item, not paperwork. If you're building a licence application, changing key personnel, or vetting a Canadian supply partner from abroad, the clearance roster shapes your timeline and your corporate structure. Here's how the system works in 2026, and how to plan around it.

Who needs a security clearance

Section 50 of the Cannabis Regulations sets out who must hold a clearance. The list covers ownership, governance, and the operational roles that touch product or site security. For a corporate licence holder, that means:

  • Directors and officers of the corporation
  • Any individual who exercises, or could exercise, direct control over the corporation
  • The responsible person and any alternates
  • The head of security
  • The master grower, for cultivation licences
  • The quality assurance person and qualified alternates, for processing licences

An individual applying for a licence in their own name needs a clearance too. The requirement flows from the Cannabis Act's core policy goal: keeping organized crime and diversion risk out of the legal supply chain. Analytical testing and research licences follow different rules, and clearance applications tied to them are exempt from fees under the Cannabis Fees Order.

One person can hold more than one designated role. A master grower can also serve as the responsible person, for example. That's a common way for smaller licence holders to keep the clearance count, and the cost, down.

How the CTLS application process works

Every clearance application is individual. Each person creates their own CTLS account and submits their own application with identity details, five years of address and employment history, and consent for background checks. From there the sequence is fixed:

  1. The individual submits the security clearance application in the CTLS.
  2. The licence applicant's responsible person links it to the licence application or existing licence.
  3. Health Canada issues an invoice. The fee is $2,041 per application as of 1 April 2025, and it's non-refundable.
  4. Checks begin only after full payment and after the linked licence application passes initial screening.

The background check itself covers criminal record history, law enforcement databases, and known associations. Timelines vary with the complexity of an applicant's history and the department's queue. Two details catch applicants out. Payment doesn't guarantee a clearance will be granted. And if you withdraw a submitted application, a new one later means paying the fee again.

How Health Canada assesses risk

Subsection 53(2) of the Cannabis Regulations lists the factors officials weigh. These include the circumstances, seriousness, number, and recency of any relevant events or convictions, any association with organized crime, and whether there are reasonable grounds to suspect the applicant could be induced to commit an act that risks public health or safety. The test is forward-looking risk, not a clean-record requirement.

If Health Canada intends to refuse, the applicant gets written notice and at least 20 days to make written representations before a final decision. Refusals can also be challenged in Federal Court, which has overturned the department before when its reasoning didn't hold up.

A granted clearance is valid for a set term of up to five years. Renewals go through the same CTLS process, so start well before expiry. A lapsed clearance in a mandatory role puts the licence itself at risk.

Planning clearances into your licence timeline

Treat the clearance roster as a project plan. Submit all clearance applications alongside the licence application, since Health Canada processes them in parallel and the slowest clearance sets your pace. Name cleared alternates for the responsible person and quality assurance roles, so one departure doesn't stall operations. When key personnel change mid-licence, the incoming person needs their clearance before taking on the role, not after.

For international buyers, the clearance regime is also a due-diligence signal. A Canadian partner that keeps its roster current, with alternates in place, is showing you the same discipline you'd expect in GACP certification or export permit management. It belongs on the same checklist you use to vet a Canadian Licensed Producer.

Frequently Asked Questions

Who needs a Health Canada cannabis security clearance?

Section 50 of the Cannabis Regulations requires clearances for individual licence holders, directors and officers of corporate licence holders, individuals who control the corporation, the responsible person and alternates, the head of security, the master grower for cultivation licences, and the quality assurance person for processing licences.

How much does a cannabis security clearance cost?

The fee is $2,041 per application as of the 1 April 2025 adjustment under the Cannabis Fees Order. It applies to each individual who needs a clearance, it's non-refundable, and Health Canada begins checks only after the invoice is paid in full.

How long is a cannabis security clearance valid?

A clearance is valid for a set term of up to five years. Renewal applications go through the Cannabis Tracking and Licensing System and should be started well before expiry, because a lapsed clearance in a mandatory role puts the licence at risk.

What happens if Health Canada intends to refuse a clearance?

The applicant receives written notice and at least 20 days to submit written representations before a final decision. A refusal can also be challenged in Federal Court, which has overturned Health Canada clearance decisions in past cases.

Can a cannabis licence be issued before all clearances are granted?

No. Health Canada will not issue a cultivation, processing, or sale for medical purposes licence until every individual required under the Cannabis Regulations holds a valid security clearance, which is why clearance applications should be filed alongside the licence application.
